OVERVIEW

Welcome to Meshara. Meshara is operated by Meshara India Private Limited. Throughout these Terms, the words “Meshara”, “we”, “us” and “our” refer to Meshara and/or Meshara India Private Limited, as applicable.

We operate this website and online store, together with all related information, content, features, products, tools and services provided through it (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce technology that enables us to offer our products and Services to you.

These Terms of Service (“Terms”) govern your access to and use of our Services and your purchase of products from Meshara.

By accessing our website, creating an account, placing an order or otherwise using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.

Nothing in these Terms is intended to restrict any rights that cannot legally be excluded or limited under applicable consumer-protection law.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

By using our Services, you represent that you are legally capable of entering into a binding contract under the laws applicable to you.

If you permit a minor to access our Services using a device, payment method or account under your control, you are responsible for such use to the extent permitted by applicable law.

You agree to provide complete, current and accurate information when placing an order or creating an account, including your name, email address, phone number, billing details and delivery address.

You are responsible for safeguarding your account credentials and for activities conducted through your account. You must notify us promptly if you believe your account has been accessed without authorization.

SECTION 2 — OUR PRODUCTS

Meshara offers jewellery, accessories and related products as displayed on our website.

We make reasonable efforts to display product photographs, colours, dimensions, designs, finishes and descriptions as accurately as possible. However, actual colours and appearance may vary slightly depending on your device, screen settings, lighting conditions and photography.

Minor differences in colour, finish, stone placement or detailing that do not materially affect the product may not constitute a defect.

Product descriptions, prices, designs and availability may be changed without prior notice.

We reserve the right to discontinue products or limit quantities available to a customer, location or jurisdiction where reasonably necessary.

SECTION 3 — ORDERS AND ACCEPTANCE

Placing an order constitutes an offer to purchase the selected products.

An order is considered accepted after we successfully receive payment and confirm the order.

Meshara reserves the right to refuse, cancel or limit an order where reasonably necessary, including in cases involving:

  • incorrect pricing or product information;
  • suspected fraud or unauthorized transactions;
  • product unavailability;
  • unusually large quantities;
  • delivery restrictions; or
  • technical or payment-processing errors.

Where we cancel an order after receiving payment, the applicable amount will be refunded to the original payment method.

Please review your order carefully before completing payment. Once processing has begun, cancellation may not always be possible.

Meshara currently accepts prepaid orders only. Cash on Delivery (COD) is not available.

SECTION 4 — PRICING, TAXES AND PAYMENT

All prices displayed on our Indian storefront are stated in Indian Rupees unless otherwise indicated.

Where applicable, displayed Indian prices are inclusive of applicable taxes unless specifically stated otherwise.

Prices, discounts, promotional offers and coupon codes may change without notice.

The price charged will normally be the price shown at the time your order is successfully placed.

International orders may be subject to customs duties, import taxes, handling charges or other government levies imposed by the destination country. Such charges, where applicable, are normally the responsibility of the customer and are not controlled by Meshara.

You agree to provide accurate and authorized payment information and confirm that you have the right to use the payment method selected.

SECTION 5 — SHIPPING AND DELIVERY

Meshara ships within India and internationally.

Dispatch

Orders are generally processed and dispatched within 1–2 working days after successful payment confirmation.

Orders placed on weekends or public holidays may be processed on the next working day.

Delivery Within India

Most domestic orders are expected to arrive approximately 2–4 working days after dispatch, depending on courier serviceability and destination.

Delivery estimates are not guaranteed.

International Delivery

International delivery timelines vary according to the destination country, courier service, customs clearance and local delivery conditions.

International shipping charges, where applicable, will be communicated or calculated during checkout.

Free Shipping

Meshara offers free shipping within India on eligible orders above ₹1,000.

International shipping charges are calculated separately according to destination.

Tracking

Tracking information will be provided after dispatch through the contact information supplied with the order, which may include email, SMS and/or WhatsApp where available.

Insured Shipments

Meshara shipments are insured during transit.

If a shipment is officially confirmed as lost in transit by our logistics partner, Meshara will offer either:

  • a replacement product at no additional product cost, subject to availability; or
  • a 100% refund of the amount paid for the lost order.

We aim to provide the appropriate resolution within 1–2 working days after the shipment is officially confirmed as lost.

Meshara will reasonably assist customers with delayed or lost shipments. This provision replaces the generic Shopify wording that transferred all transit risk to the customer immediately after carrier handover.

SECTION 6 — RETURNS, REPLACEMENTS AND REFUNDS

Purchases are subject to our Returns & Refunds Policy, available separately on our website.

Returns or replacements are generally accepted only where a product received is:

  • visibly damaged;
  • defective; or
  • materially different from the product ordered.

Customers must report an eligible issue to meshara.support@gmail.com within 3 days of delivery.

We strongly recommend recording a clear, uninterrupted unboxing video beginning before the parcel is opened and showing the packaging, opening process and product condition.

Where requested, customers must provide the order number, photographs, unboxing video and description of the issue.

Returns are not ordinarily accepted solely because of change of mind, personal preference, colour preference, styling preference or similar reasons.

Approved refunds will be processed after the relevant product has been received and inspected where a physical return is required.

Refunds will generally be issued to the original payment method.

SECTION 7 — PRODUCT CARE AND NORMAL WEAR

Jewellery requires appropriate care.

Exposure to perfumes, cosmetics, chemicals, excessive moisture, friction, improper storage or rough handling may affect a product's appearance or longevity.

Anti-tarnish or water-resistant characteristics do not mean that jewellery is permanently tarnish-proof or waterproof.

Customers should follow the care instructions provided on our website or with the product.

Normal wear and tear, damage caused by misuse, improper storage or accidental damage after delivery is not considered a manufacturing or delivery defect.

SECTION 8 — INTELLECTUAL PROPERTY

All content appearing on the Meshara website, including the Meshara name, logo, branding, photographs, product images, graphics, videos, written content, product names, designs, layouts and other materials, is owned by or licensed to Meshara unless otherwise indicated.

Such content is protected by applicable copyright, trademark and other intellectual-property laws.

You may use our website for personal and non-commercial shopping purposes only.

You may not, without our prior written permission:

  • reproduce or republish our content;
  • commercially use our photographs or product imagery;
  • copy our branding or designs;
  • distribute or modify our materials;
  • scrape or systematically extract our content; or
  • use Meshara trademarks, logos or other proprietary material.

All rights not expressly granted are reserved.

SECTION 9 — THIRD-PARTY SERVICES AND LINKS

Certain Services may rely on third-party providers, including payment processors, courier partners, analytics providers, social-media platforms and other technology providers.

Our website may also contain links to third-party websites.

Meshara does not control third-party websites and is not responsible for their independent content, policies, security or business practices.

Customers should review the relevant third party's policies before transacting with or providing information to them.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Meshara is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our store are made directly with Meshara.

By using the Services, you acknowledge that Shopify is not the seller of Meshara products and is not responsible for the sales transaction between you and Meshara, including any injury, damage or loss arising from products purchased from us, to the extent permitted by applicable law.

This section retains the substance of the Shopify-specific provision included in your original template.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy, available on our website.

Because our store is hosted by Shopify, certain information may also be processed by Shopify and other service providers that assist in operating our store.

By using our Services, you acknowledge that information may be processed or transmitted through service providers located in India or other countries where required to provide the Services.

SECTION 12 — REVIEWS, FEEDBACK AND USER CONTENT

If you submit product reviews, photographs, suggestions, comments or other content to Meshara, you confirm that you have the right to submit such content.

You grant Meshara a non-exclusive, worldwide, royalty-free right to use, reproduce, display and publish that content for legitimate business and promotional purposes, subject to applicable law.

You must not submit content that:

  • infringes another person's intellectual-property or privacy rights;
  • is unlawful, defamatory, abusive or misleading;
  • contains malicious software; or
  • falsely represents your identity or experience.

We may moderate or remove content that violates these requirements.

SECTION 13 — ERRORS AND INACCURACIES

Occasionally, our website may contain typographical errors, inaccurate descriptions, incorrect pricing, availability errors or other omissions.

We reserve the right to correct such errors, update information or cancel affected orders where reasonably necessary.

If an order is cancelled because of a material error after payment has been received, the applicable amount will be refunded.

SECTION 14 — PROHIBITED USES

You may not use the Services:

  • for unlawful or fraudulent purposes;
  • to violate applicable laws or regulations;
  • to infringe intellectual-property rights;
  • to harass, threaten or harm another person;
  • to transmit malicious code;
  • to obtain unauthorized access to our systems;
  • to conduct fraudulent transactions;
  • to scrape or systematically extract website content without authorization;
  • to send spam or unsolicited communications; or
  • to interfere with the operation or security of our website.

We may restrict or terminate access where these Terms are violated.

SECTION 15 — SUSPENSION OR TERMINATION

We may suspend or terminate access to our Services where reasonably necessary because of fraud, misuse, unlawful activity, security concerns or a material violation of these Terms.

Termination does not affect rights or obligations that arose before termination, including outstanding payment or refund obligations.

SECTION 16 — DISCLAIMER OF WARRANTIES

We aim to provide accurate information and quality products, but our website and Services are provided subject to applicable law.

We do not guarantee that website access will always be uninterrupted, error-free or available without technical issues.

Except for warranties, rights or remedies that cannot legally be excluded, no additional warranty is implied beyond those expressly provided by Meshara.

Nothing in these Terms excludes, restricts or modifies statutory consumer rights that cannot legally be excluded or restricted.

SECTION 17 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Meshara will not be liable for indirect, incidental, special or consequential losses resulting from use of the Services where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Our liability in relation to an individual purchase will be subject to applicable consumer-protection laws and other mandatory legal requirements.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Meshara against claims, losses or reasonable costs arising directly from:

  • your material breach of these Terms;
  • your unlawful use of the Services; or
  • your infringement of another person's legal rights.

This section does not limit any non-waivable consumer rights.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue to remain valid and enforceable.

SECTION 20 — ENTIRE AGREEMENT AND WAIVER

These Terms, together with our Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy and other policies expressly incorporated by reference, constitute the agreement governing use of our Services.

Failure by Meshara to enforce a provision on one occasion does not constitute a permanent waiver of that provision.

SECTION 21 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our prior written consent.

Meshara may transfer its rights or obligations where reasonably required as part of a restructuring, acquisition, sale of business or transfer to an affiliated entity, subject to applicable law.

SECTION 22 — GOVERNING LAW AND JURISDICTION

These Terms and transactions with Meshara shall be governed by the laws of India.

Subject to applicable consumer-protection laws and any jurisdiction that cannot legally be excluded, disputes shall be subject to the jurisdiction of the competent courts in Delhi, India.

Nothing in this provision prevents a consumer from exercising rights available to them under applicable consumer-protection legislation.

This replaces the generic jurisdiction language in the original Shopify template.

SECTION 23 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our Services, business practices, legal requirements or policies.

The latest version will always be published on this page.

Where required by applicable law, material changes will be communicated appropriately.

Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
